Diliman to Start Agency Fee Collection from the Academic Rank-and-File Employees

Finally, after more than a year since the signing, ratification and BOR approval of the Collective Negotiation Agreement (CNA) between the U.P. Administration and the All UP Academic Employees Union (AUPAEU), UP Diliman Chancellor Sergio S. Cao released a memo dated February 18, 2010 stating that the UP Diliman unit will collect starting April 2010 the agency fee from the academic rank-and-file employees who are not members of AUPAEU.

Part of the CNA is the collection of the agency fee, which is 0.2% of the salaries of the faculty and REPS. This CNA provision is stated in Article IX Section 3: “[…] the UNIVERSITY shall deduct an amount equivalent to the UNION’s monthly membership fee from the salaries of all faculty and REPS who are not members of the All-UP Academic Employees Union, but who are a part of the negotiating unit and enjoy the benefits under this Collective Negotiating Agreement. Individual authorization is not necessary for the implementation of the provision.”

The CNA, together with the said provision on the agency fee, was signed by UP President Emerlinda Roman and AUPAEU National President Dr. Erlinda Castro Palaganas on December 12, 2008. The CNA was ratified by members of the rank-and-file faculty and REPS on January 2009 and was approved by the BOR on January 28, 2009.

In the first place, the AUPAEU does not  see any reason why the UP Diliman Chancellor stalled the collection of the agency fee. It was clearly stated by Vice President for Administration (VPA) Arlene Samaniego in a memorandum dated February 24, 2009 that “The University shall likewise deduct from the salaries of faculty members and REPS who are not members of the Union but who are considered part of the negotiating unit, the amount equivalent to 0.002% of their salary, without the need of written authorization. Such Agency Fee shall be remitted to the Union not later than 45 days after the deductions are made.” Later, VPA Samaniego corrected the percentage from 0.002% to 0.2% in the memorandum dated June 16, 2009.

Subject: COLLECTION OF AGENCY FEE

Pursuant to the Collective Negotiation Agreement (CNA) between the University and All UP Academic Employees Union (AUPAEU), UP Diliman shall deduct the agency fee which is equivalent to .2% of the monthly salaries of all academic rank and file employees (union and non-union members who are considered part of the negotiating unit and receiving the benefits under the CNA) starting April 2010.

The deduction shall include the uncollected equivalent amounts from February 2009 to March 2010.

The collected agency fee shall be remitted to the AUPEAU.
